Flying With Edibles: Is It Possible To Do, What Consequences Await You, What Is Better Not To Do

Most travelers know perfectly well what can and cannot be transported on an airplane. But some of them are willing to take risks and bring prohibited items on board. Let’s clarify that traveling with edibles from a state where cannabis is legalized to a state where it is also legalized is not allowed.

The most popular smuggling of flying internationally with edibles was marijuana – 36.7% of men and 22.8% of women smuggled it in their luggage at least once in their lives. The second most popular answer is prescription drugs. The passengers knew that permission was needed to transport them, but they took medication with them, without properly registering them.

For example, in some marijuana supermarkets in California, candies, marmalade, and baked goods on the shelves look very innocent, and if you think about flying with marijuana edibles, you will get an analysis, handcuffs, and an isolation ward.

Starting October 17, passengers on domestic flights in Canada will be able to take marijuana on the road. Fly with edibles was reported by the press secretary of the Minister of Transport, Dolphin Denis.

At the same time, travelers are not allowed to fly with THC edibles on international flights, even if the plane is heading to a country or US state where this drug is also legalized.

You cannot do this for a number of reasons:

1. At the moment a person passes through the Transportation Security Administration (TSA) checkpoint, he will enter the territory of the airport, aircraft, and airspace, which are continuously monitored by the state.

2. Cannabis and products containing cannabis are prohibited by federal law.

If you want to smuggle baked goods that contain cannabis, this is against the law.

If you still want to smuggle something with cannabis, including baked goods, then according to the TSA, the product should not contain more than 0.3% THC. In this case, these will be the only products that are allowed by law (bringing weed on a plane in checked baggage or in carry-on luggage).

Remember, TSA’s primary mission is to provide safety and threat detection to passengers and aircraft. Employees will not deliberately search your belongings for illegal substances, but if they find drugs during a check, they will hand you over to law enforcement.

Anyone who smuggles a prohibited substance or a product containing it across the border automatically becomes a violator. There was a case when a young man brought from the UK pills that are considered psychostimulants there, and in his country – narcotic. He was very lucky – he was given only six years probation.

In fact, it is forbidden not only to bring weed on planes but also to export the same marijuana from Amsterdam. On leaving the Netherlands, they are arrested in such a way that the police simply walk through the carriages with the dog.

If a narcotic or psychotropic substance is found not at the border, but, for example, while walking along the street, the offender will be charged with storage (punishment – up to three years, for a large volume – from three to six, for an especially large one – ten to fifteen years). But if it is proved that the citizen crossed the border with the substance, it will be regarded as contraband.

If a tourist doesn’t think about bringing edibles on a plane and does not store or distribute but is under its influence, then the responsibility is of an administrative nature, and it is important: a person sitting behind the wheel in such a state may be deprived of his rights, as in the case refusal of medical examination.

Marijuana is still an illegal drug under federal law, and federal authorities operate at airports with security measures. Thus, as in Oregon, Washington, Colorado, Alaska, and Nevada, the transport of legally purchased goods will be stopped by law enforcement agencies, so think twice about doing this.

Now let’s talk about the consequences

Everything will depend on what state you are in and in what form you smuggled the drug. If you want to bring edibles on a plane and they contain more than 0.3% THC, then they will be illegal. Once the drug is found, you will be handed over to law enforcement.

Is it safe to bring edibles on a plane or whether you are sent to jail or a fine will depend, as already mentioned, on the state? Also, the question of whether you will be detained may depend on the airport. For example, in Los Angeles you will not be detained if you are transporting a drug weighing more than 28.5 grams, that is, you can make baked goods with you.

Also in Massachusetts, at Boston Logan International Airport, when edible cannabis is found, airport employees can act at their own discretion. This means that they can either call the police or find it unnecessary.

In some European countries, candy and marmalade are sold with the image of a hemp leaf on the package, but it is not included in the product. Particularly cautious tourists are afraid to take edibles on a plane with them. As such, the depiction of a plant leaf on objects is not prohibited, unless it is regarded as drug propaganda.

Of course, in the United States, few people pay attention to the drawing of a leaf of a plant on any object or food, if they do not contain marijuana.

If you are still wondering if it is possible to smuggle edibles on a plane domestic with marijuana to be legal, then the answer is no. Do not try to sneak edibles on the plane, this is illegal and violates the laws of all states at the moment. It is forbidden to bring products containing more than 0.3% THC, remember this.

Here’s a small example of a guy who tried to smuggle illegal goods into the country on an international flight.

In August last year, the artist Maxim Gert was sentenced to eleven and a half years in a strict regime colony. In 2017, a traveler who was traveling with edibles internationally tried to bring into his country a 1.5-liter bottle of ayahuasca, a decoction considered a hallucinogen, made by shamans of the Indian tribes of the Amazon basin. During the appeal, the sentence was changed to two years in prison – in early March, Gert was released.
